Supreme Court Cuts Short Battle Over Net Neutrality Regulation

  • Supreme Court rejects industry challenge of 2015 net neutrality rules

The Supreme Court rejected requests by the broadband industry and the Trump administration to vacate a lower court's 2017 decision that upheld the Obama-era net neutrality rules, which prohibited broadband providers from blocking or throttling traffic and from charging higher fees for prioritized delivery.

Industry trade group USTelecom, one of the groups that challenged the 2015 net neutrality rules, said the high court's action was "not surprising". The Supreme Court also declined to remove the precedential value of the D.C. Circuit's 2016 opinion.

The "DACA" program - formally, Deferred Action for Childhood Arrivals - was created by the Obama Administration, and has spared almost 700,000 immigrant youths from being sent back to countries from which they came as children with their parents. After two federal judges issued injunctions requiring the government to continue administering the program, the Justice Department bypassed normal appellate procedure and went directly to the Supreme Court on January 18 to vindicate its right to terminate the program.

Million Floridians Will Have Their Voting Rights Restored as Amendment 4 Passes
Meanwhile, the ACLU paid more than $5 million in advertising on TV and via social media to get it passed, according to CNBC. Those who committed sexual offenses or murder are excluded from having their ability to vote restored.

If the new cases proceed at the Court on the regular timetable and review is granted, they could be heard and decided by the end of the current term late in June. The Justice Department has also agreed to suspend its recent suit against California over the state's new net neutrality law, at least until the case before the D.C. Circuit is resolved.

AT&T and other telecoms had asked the high court to void the ruling; the Federal Communications Commission repealed net neutrality past year.

In this case, there were no less than seven petitions - each sent by a different arm of the cable industry - asking the Supreme Court to review a decision by the Washington DC Court of Appeals that said the Obama-era rules were legal.

Control of Congress at stake in U.S. midterm elections
And 35 Senate seats are in play, as are nearly 40 governorships and the balance of power in virtually every state legislature. Even if they lose the House, if Republicans keep the Senate, they still get to control the approval process for new judges.

The Ninth Circuit heard oral arguments in the case pending before it in May but has not yet issued a ruling.

The new rules, which gave internet service providers greater power to regulate the content that customers access, are now the subject of a separate legal fight after being challenged by numerous groups that backed net neutrality.

Additional challenges to DACA are winding their way through appeals courts in NY and the District of Columbia following district court rulings against Trump's plan to end the program. The goal was to protect from deportation undocumented immigrants who were brought to the country as children, but many Republicans called it executive overreach and have remained opposed to the program. His work has appeared here since mid-2011.
