Rudy Giuliani keeps moving the bar on the Mueller investigation

This comes as ABC News has learned that Cohen claims that President Trump knew about the infamous Trump Tower meeting in advance.

Giuliani said Mueller is "not entitled" to ask any questions about obstruction of justice, since the president was authorized under the Constitution to remove FBI Director James Comey.

Democrats also have pointed to a roundtable discussion that Judge Kavanaugh held with lawyers several years ago, according to The Associated Press, in which he suggested the Supreme Court wrongly decided the 1974 case that forced President Richard Nixon to hand over the Watergate tapes.

He said: "I have been sitting here looking in the federal code trying to find collusion as a crime.Collusion is not a crime".

Up until the the day before Mueller unveiled Gates' plea deal, there were contradicting reports on whether he would actually flip. The trial is expected to drag on for at least three weeks, with jury selection for the case beginning on Tuesday.

In an interview on CNN, the former New York City mayor suggested that Trump would have had to pay Russian operatives to collude.

If Trump or his aides knew in advance that Russian Federation had the trove of stolen emails and did nothing to alert federal authorities, they could be accused of covering up the crime of stolen emails or working as foreign agents.

Critics saw Giuliani's statements as indicative that the president's defense against accusations of working with Russian contacts to help him win the election is rapidly unraveling.

"It seems to me his default position is to lie", Mr Giuliani said of Mr Cohen, who in May he said was an "honest, honourable lawyer". He said he has a "sense" that Mueller is getting to the end of his investigation.

He called Trump's former attorney Michael Cohen a "scoundrel", accusing him of deceptively recording meetings after assuring those involved that he was not doing so. "The hacking is the crime".

Trump and his lawyers are right that the term "collusion" isn't a precise one when it comes to US law. "Collusion is not a crime".

Giuliani also said Mueller has "conflicts of interest". Citing two unnamed White House advisers, the newspaper said Mueller and the Trump National Golf Club in Virginia had a dispute over fees when Mueller resigned as a member in 2011. In fact, prosecutors said last week they don't expect the word "Russia" to be mentioned at all. "I suspect that we'll see that in some of his rulings". He also faces charges of witness tampering.
